In these Terms, “Winklergut”, “we”, “our” and “us” refer to Winkler Gut GmbH.
2. Scope of Application
These Terms & Conditions apply to the use of this Website and to all contractual relationships between Winklergut and its guests relating to accommodation, retreats, workshops, private events, corporate retreats and other hospitality services offered directly by Winklergut.
They apply to reservations made:
through www.winklergut.at;
by email;
by telephone;
in person; or
through any other direct communication with Winklergut.
Reservations made through third-party booking platforms, including Lodgify, Booking.com, Airbnb and Vrbo, remain subject to the additional terms and conditions of the respective platform. Where payment processing, cancellation procedures or reservation management are governed by the booking platform, those terms shall apply alongside these Terms.
By accessing this Website, making a reservation or purchasing any service offered by Winklergut, you confirm that you have read, understood and accepted these Terms & Conditions.
Nothing contained in these Terms limits or excludes any mandatory rights granted to consumers under Austrian or European law.
3. Applicable Law
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Austria.
Where applicable, the contractual relationship between Winklergut and its guests shall be subject to the relevant provisions of Austrian and European legislation, including but not limited to:
Allgemeines Bürgerliches Gesetzbuch (ABGB);
Unternehmensgesetzbuch (UGB), where applicable;
Konsumentenschutzgesetz (KSchG);
Fern- und Auswärtsgeschäfte-Gesetz (FAGG);
E-Commerce-Gesetz (ECG);
Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR); and
Austrian Datenschutzgesetz (DSG).
Mandatory statutory consumer rights remain unaffected by these Terms.
4. Services
Winklergut is a boutique farm stay located in Upper Austria, offering accommodation together with thoughtfully designed hospitality experiences in a peaceful countryside setting.
Depending on the season and availability, our services may include accommodation, yoga retreats, wellness retreats, workshops, seminars, corporate retreats, private celebrations, exclusive venue hire, seasonal experiences and other hospitality services described on the relevant pages of this Website.
The scope, duration and availability of individual services may vary throughout the year.
All descriptions, photographs, videos, floor plans and other promotional material are intended to provide a general representation of the property and our services. While every effort is made to ensure that the information published is accurate and up to date, minor variations may occur and shall not constitute a contractual defect.
Winklergut reserves the right to improve, modify or discontinue individual services where reasonably necessary for operational, seasonal, legal or safety reasons.
5. Booking and Contract Formation
Reservations may be requested through our Website, by email, by telephone or through other written communication.
A reservation request does not constitute acceptance by Winklergut.
A binding contract is concluded only when:
a written booking confirmation has been issued by Winklergut;
an online reservation has been successfully completed; or
where applicable, the required deposit has been received and confirmed.
Until one of these conditions has been fulfilled, availability cannot be guaranteed.
Requests regarding room preferences, dietary requirements, allergies, accessibility, arrival times or additional services shall be treated as requests only and become contractually binding only where expressly confirmed in writing by Winklergut.
Winklergut reserves the right to decline reservation requests where reasonable grounds exist, including but not limited to:
lack of availability;
incomplete or incorrect booking information;
previous material breaches of these Terms;
safety or operational concerns; or
circumstances beyond the reasonable control of Winklergut.
6. Prices
Unless otherwise stated, all prices published by Winklergut are quoted in Euro (€).
Prices include Austrian Value Added Tax (VAT) where applicable.
Local tourism taxes or other statutory charges imposed by public authorities may be charged separately where required by law.
Prices published on this Website or in promotional material may change at any time prior to confirmation of a reservation.
Once a reservation has been confirmed, the agreed price shall remain binding unless changes are requested by the guest or become necessary due to legal requirements.
Despite careful administration, obvious typographical, technical or pricing errors may occasionally occur. Winklergut reserves the right to correct such errors before confirming a reservation.
Special offers, promotional rates and package prices are subject to availability and any additional conditions applicable to the respective offer.
7. Payment Terms
Payment conditions vary depending on the type of accommodation, retreat, workshop, event or other service booked and will be communicated during the booking process or set out in the booking confirmation.
Unless otherwise agreed in writing, Winklergut may require:
full payment before arrival;
a deposit to secure the reservation;
partial payment before arrival, with the remaining balance payable before or during the stay; or
payment upon receipt of an invoice for approved business or corporate bookings.
Payments may be made by bank transfer, credit or debit card, secure online payment providers or any other payment method accepted by Winklergut at the time of booking.
Invoices become due on the payment date specified in the booking confirmation or invoice.
Failure to comply with agreed payment terms may result in cancellation of the reservation, suspension of booked services or other remedies available under applicable Austrian law.
Where permitted by law, Winklergut reserves the right to charge statutory default interest and reasonable recovery costs for overdue payments.
8. Deposits
To secure certain reservations, including exclusive property rentals, retreats, workshops, private events, corporate retreats and group bookings, Winklergut may require a deposit.
The amount of the deposit and the applicable payment deadline will be stated in the booking confirmation.
Unless otherwise agreed in writing, a reservation shall only be considered confirmed once the required deposit has been received.
If the requested deposit is not received within the specified payment period, Winklergut may cancel the reservation and release the booked dates without further notice.
Unless expressly agreed otherwise, any deposit paid shall be credited towards the total amount payable for the reservation.
9. Cancellation by Guests
Cancellation requests must be submitted in writing by email.
The effective date of cancellation shall be the date on which the written notice is received by Winklergut.
The cancellation conditions communicated during the booking process or included in the booking confirmation form part of the accommodation or service contract and shall apply to the relevant reservation.
Where cancellation fees apply, they may be deducted from any refundable amount before reimbursement is processed.
Refunds, where applicable, will generally be made using the same payment method used for the original reservation, unless otherwise agreed.
Winklergut strongly recommends that guests obtain appropriate travel cancellation insurance to protect themselves against unexpected events such as illness, accidents, travel disruption or other circumstances that may prevent them from travelling.
10. Changes or Cancellation by Winklergut
Winklergut may modify, postpone or cancel reservations where performance of the agreed services becomes impossible or unreasonable due to circumstances beyond its reasonable control.
Such circumstances may include, but are not limited to:
natural disasters;
severe weather conditions;
fire;
flood;
governmental measures or travel restrictions;
public health emergencies;
epidemics or pandemics;
technical failures;
interruptions to essential utilities;
safety concerns; or
any other event of force majeure.
Where reasonably possible, Winklergut will offer guests one of the following options:
an alternative travel date;
comparable accommodation or services; or
a refund of payments already received for the affected reservation.
Unless mandatory law provides otherwise, Winklergut shall not be liable for indirect or consequential losses, including transport costs, airline tickets, accommodation booked elsewhere, visa expenses, loss of earnings or similar expenses arising from the cancellation.
11. Retreats, Workshops and Events
Winklergut regularly hosts retreats, workshops, seminars, corporate events and private gatherings that require careful planning and coordination.
To ensure the best possible experience for all participants, Winklergut reserves the right to make reasonable changes where necessary, including:
adjusting daily schedules;
modifying programmes;
changing activity locations;
replacing teachers, facilitators or speakers due to illness or unforeseen circumstances; or
substituting activities of a comparable nature where appropriate.
Where an event requires a minimum number of participants, Winklergut reserves the right to cancel the event if that minimum is not reached.
Should Winklergut cancel an event before its commencement, participants will be offered either an alternative date or a refund of payments already received for that event.
Such changes shall not constitute a contractual defect provided that the essential nature and purpose of the booked experience remain substantially unchanged.
Winklergut shall not be responsible for travel arrangements or expenses incurred with third-party providers.
12. Third-Party Booking Platforms
Reservations made through Lodgify, Booking.com, Airbnb, Vrbo or other third-party booking platforms are additionally subject to the contractual terms and conditions of the respective provider.
Payment processing, reservation management, cancellation procedures and refund policies administered by those platforms may differ from the policies applicable to direct bookings made with Winklergut.
Where a reservation has been made through a third-party booking platform, guests may be required to submit requests relating to cancellations, amendments or refunds directly through that platform.
Nothing in these Terms shall override the contractual obligations that arise between the guest and the relevant booking platform.
13. Arrival and Departure
Check-in and check-out times will be communicated during the booking process and confirmed prior to arrival.
Requests for early check-in or late check-out are subject to availability and cannot be guaranteed. Additional charges may apply where such requests can be accommodated.
Guests expecting to arrive significantly later than the agreed arrival time are kindly requested to inform Winklergut in advance.
Unless otherwise agreed, failure to arrive without prior notice may be treated as a no-show in accordance with the applicable cancellation conditions.
Upon departure, guests are expected to vacate the accommodation on time and return any keys or access devices provided during their stay.
14. Guest Responsibilities
Guests are expected to respect the peaceful atmosphere of Winklergut and to treat the property, its facilities and the surrounding natural environment with care and consideration.
During their stay, guests agree to:
respect other guests, neighbours and members of staff;
comply with all reasonable instructions provided by Winklergut;
supervise children under their care at all times;
use the accommodation, furnishings and facilities responsibly;
observe applicable Austrian laws and regulations; and
refrain from excessive noise, disruptive behaviour or activities that may interfere with the comfort or safety of others.
Guests shall be responsible for any damage caused intentionally or through negligent behaviour by themselves or by persons accompanying them.
Winklergut reserves the right to recover the reasonable costs of repairing or replacing damaged property.
Where a guest’s behaviour seriously compromises the safety, wellbeing or enjoyment of other guests or staff, Winklergut reserves the right to terminate the accommodation or service agreement with immediate effect. Any entitlement to a refund shall be subject to applicable Austrian law.
15. Sustainable Hospitality
Winklergut is committed to environmentally responsible hospitality and the careful stewardship of its historic property and surrounding landscape.
Guests are kindly requested to support these efforts by using water, energy and other resources responsibly, disposing of waste appropriately and respecting the natural environment, gardens, woodland and wildlife surrounding the property.
We encourage all guests to help preserve the peaceful character of Winklergut for future visitors.
16. Participation in Activities
Participation in yoga classes, wellness activities, workshops, outdoor experiences and other organised activities offered by Winklergut is voluntary.
Guests are responsible for assessing their own physical and mental fitness before participating in any activity.
Participants are encouraged to consult a medical professional before taking part in physical activities if they have any medical condition, injury or other health concern that may affect their participation.
Guests are kindly requested to inform instructors or facilitators of any relevant medical conditions, allergies, injuries or physical limitations before participating.
Unless otherwise required by mandatory law, participation in such activities is at the guest’s own responsibility.
Nothing in these Terms excludes or limits liability for damages arising from intentional misconduct or gross negligence.
17. Personal Belongings
Guests remain responsible for their personal belongings throughout their stay.
Unless liability arises under mandatory Austrian law, Winklergut accepts no responsibility for the loss, theft or damage of personal property brought onto the premises.
Guests are encouraged not to leave valuable items unattended.
18. Photography and Media
During retreats, workshops, events or other activities organised by Winklergut, photographs or video recordings may occasionally be taken for documentation or promotional purposes.
Where individuals are clearly identifiable, photographs or recordings will only be used with the person’s consent or where otherwise permitted under applicable data protection and personality rights legislation.
Guests who do not wish to appear in photographs or recordings are kindly requested to inform a member of the Winklergut team before or during the event.
19. Website Use
Users may access this Website solely for lawful purposes and in accordance with these Terms.
Users agree not to:
interfere with the operation or security of the Website;
attempt to gain unauthorised access to systems or data;
introduce malicious software or harmful code;
misuse contact forms or communication channels; or
use the Website in a manner that violates applicable law.
Where booking requests or contact forms are used, users agree to provide accurate, complete and up-to-date information.
Winklergut reserves the right to restrict access where misuse of the Website is reasonably suspected.

22.1 Right of Withdrawal
Where applicable, consumers may have a statutory right to withdraw from certain contracts concluded online within fourteen (14) days without giving reasons.
However, pursuant to the Austrian Distance and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz – FAGG), the right of withdrawal generally does not apply to:
accommodation booked for a specific date or period;
retreats;
workshops;
seminars;
leisure activities booked for specific dates;
private events;
catering services booked for specific dates; or
other services exempted under applicable legislation.
Where a statutory right of withdrawal exists, guests may exercise that right by notifying Winklergut in writing before the applicable withdrawal period expires.
Where no statutory withdrawal right exists, cancellations shall be governed exclusively by the applicable booking conditions.
22.2 Statutory Warranty
Guests retain all statutory warranty rights provided under Austrian law.
Where services are defective, consumers may be entitled to the remedies provided by applicable legislation, including repair, replacement, price reduction or termination of the contract where legally justified.
Nothing contained in these Terms shall limit any mandatory statutory warranty rights.

26. Amendments to these Terms
Winklergut reserves the right to amend these Terms & Conditions where necessary to reflect changes in legislation, regulatory requirements, business operations or the services offered.

The continued use of this Website following publication of updated Terms constitutes acceptance of the revised Terms, unless mandatory statutory provisions require otherwise.
